Senate amendment to the 2nd edition makes the following changes.

Adds a section amending GS 42-26 by amending when a landlord may recover attorney’s fees from a tenant to only require the landlord to have been the prevailing party when recovering fees in cases where a tenant appeals a summary ejectment to superior court and the tenant knew or should have known that the appeal was frivolous, unreasonable, without foundation, in bad faith, or solely for the purpose of delay (was, the landlord had to be the prevailing party to recover attorney’s fees paid or owed pursuant to a lease, with the stated cap). Effective retroactively to September 9, 2024.
